Legal & Regulatory Disclaimer

This page explains Texty's role and regulatory position. It applies to everyone who uses the Texty platform at texty.app and our payment pages (the "Service"), and should be read with our Merchant Terms of Service, Customer Payment Terms, Privacy Policy and Refund & Dispute Policy.

The Service is provided by Texty Technologies Ltd (company number 17274662, registered office 102 Willmott Road, Sutton Coldfield, United Kingdom B75 5NW — "Texty", "we", "us").

1. Texty is a payment-facilitation platform

Texty provides software that lets businesses (such as tradespeople and small shops — "Merchants") create payment requests, send them to their customers, take payment, and track those payments.

Texty is not a bank, payment processor, money transmitter or financial institution, and does not hold, control or transmit customers' funds. All payment processing, settlement and payouts are carried out by our payment partner, Stripe, which is authorised and regulated to provide those services. Money paid by a customer is processed by Stripe and paid directly to the relevant Merchant; Texty does not receive or hold it.

2. Texty is not the seller, and not a party to the underlying transaction

Texty does not supply, perform, supervise or guarantee the goods, services or work that customers pay for. The agreement for that work is solely between the Merchant and its customer. Texty is not responsible for the quality, safety, timing, completion, pricing or description of any work, goods or materials, or for any dispute about them. Any such issue is a matter between the customer and the Merchant. (See clause 8 of the Merchant Terms of Service and clause 1 of the Customer Payment Terms.)

3. Buy Now, Pay Later (BNPL) — Texty is not a lender

3.1 Where Buy Now, Pay Later is offered at checkout, it is provided by third-party credit providers (such as Klarna or Clearpay) through Stripe.

3.2 Texty is not a lender, does not provide credit, and is not a party to any credit or instalment agreement. Any BNPL agreement is between the customer and the credit provider, on the credit provider's own terms and subject to that provider's own regulatory status.

3.3 Texty does not decide eligibility for BNPL, does not carry out credit checks, and makes no representation or recommendation about any credit product. Customers should read the credit provider's terms and borrow only what they can afford to repay.

3.4 The law governing Buy Now, Pay Later in the UK is changing, and customers' and providers' rights and obligations are determined by the credit provider's terms and applicable law from time to time.

4. No financial, legal, tax or other professional advice

Nothing on the Service or in our materials is financial, credit, investment, legal, tax or accounting advice. The Service and any information we provide are for general use only. You should obtain your own professional advice before making decisions, and you rely on the Service and our materials at your own risk.

5. Third parties

Texty relies on third parties to provide parts of the Service, including Stripe (payments and identity verification), credit providers (BNPL), and our hosting, database, messaging and analytics providers. Those third parties operate under their own terms and policies, and Texty is not responsible for their acts or omissions. Links to third-party sites or services are provided for convenience only and do not imply endorsement.

6. Accuracy and availability

We aim to keep the Service accurate and available, but we do not guarantee that it will be uninterrupted, error-free or up to date. We may change, suspend or withdraw all or part of the Service at any time.

7. Limitation of liability

Our liability is limited as set out in the Merchant Terms of Service (for Merchants) and the Customer Payment Terms (for customers). Nothing on this page or anywhere on the Service excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. Nothing affects a consumer's statutory rights.
